H Connect – Acceptable Use Policy (AUP)

1. Introduction
This Acceptable Use Policy (“AUP”) forms part of the Terms & Conditions of Service of H Connect (Pty) Ltd. The purpose of this AUP is to ensure responsible and lawful use of H Connect’s broadband, internet, and related services, which are provisioned via Openserve’s wholesale network infrastructure and other authorised partners.
2. General Principles
Customers must use the Services in a manner consistent with the Electronic Communications and Transactions Act (ECTA), the Regulation of Interception of Communications and Provision of Communication-Related Information Act (RICA), the Consumer Protection Act (CPA), applicable Openserve network usage policies, and other South African laws.
3. Prohibited Activities
Unlawful Activities: Hosting or distributing illegal content; copyright infringement; unauthorised access; phishing, fraud, or identity theft.
Network Abuse: Disrupting H Connect or Openserve operations; transmitting malware or DoS attacks; excessive usage that degrades network quality; unauthorised resale or redistribution of bandwidth.
Email and Messaging Abuse: Sending spam, chain letters, or forged messages.
Security Violations: Circumventing authentication; probing or scanning networks without permission; distributing security-compromising tools.
4. Fair Usage Policy
Each service plan includes a fair usage threshold. Excessive or disproportionate usage that impacts the quality of service for other users may result in bandwidth shaping, throttling, or temporary suspension. H Connect may modify thresholds and FUP rules as required to preserve network integrity.
5. Content Responsibility
Customers are solely responsible for any content they transmit, host, or make available through the Services. H Connect and Openserve act as carriers and do not monitor content except where required by law or for operational security.
6. Enforcement and Monitoring
H Connect may monitor network usage to maintain service quality and security. Violations may result in warning notices, suspension, disconnection from Openserve’s network, reporting to authorities, or termination without refund. We may notify customers of alleged violations, unless immediate action is required.
7. Reporting Abuse
Report incidents to abuse@hconnect.co.za with full details (IP address, date/time, and nature of concern).
8. Limitation of Liability
H Connect and Openserve shall not be liable for losses or damages resulting from enforcement of this Policy, including service interruptions or account terminations arising from violations.
9. Updates to the Policy
H Connect may amend this AUP periodically. The latest version will be available on our website. Continued use of the Services constitutes acceptance of the current version.
