H Connect – Terms & Conditions of Service

1. Introduction
These Terms and Conditions (“Terms”) govern the use of broadband and internet connectivity services (“Services”) provided by H Connect (Pty) Ltd (“H Connect”, “we”, “us”, or “our”). By using our Services, you agree to be bound by these Terms. If you do not agree, you must refrain from using the Services.
2. Relationship with Openserve
H Connect is an official partner and reseller of broadband infrastructure provisioned through Openserve, a wholesale network operator in South Africa. All connectivity and line installations are subject to Openserve’s infrastructure availability, technical feasibility, and service-level parameters. While H Connect manages the customer relationship, billing, and support, Openserve remains responsible for maintaining the physical network infrastructure.
3. Service Provisioning
3.1 Services are provisioned on the basis of network availability and feasibility at the customer’s address.
3.2 H Connect reserves the right to decline a service request where technical feasibility is not confirmed by Openserve or other network partners.
3.3 Installation lead times are subject to Openserve’s scheduling and operational timelines.
3.4 H Connect does not guarantee uninterrupted service. Connectivity may be affected by maintenance, network outages, or other circumstances beyond our control.
4. Customer Responsibilities
4.1 You agree to provide accurate information when applying for a service.
4.2 You are responsible for safeguarding your account credentials and any equipment provided.
4.3 You agree not to use the Services for unlawful purposes, including spam, hacking, or copyright infringement.
4.4 You are required to comply with the Acceptable Use Policy (AUP) at all times.
5. Equipment and Installation
5.1 Equipment (routers, ONTs, or modems) supplied by H Connect remains the property of H Connect or its suppliers until paid for in full.
5.2 You may not tamper with, relocate, or alter equipment installed by Openserve or its agents.
5.3 Faults caused by customer tampering or unauthorised modification will result in repair or replacement charges.
6. Billing and Payments
6.1 All payments are processed securely via Paystack, our authorised payment gateway.
6.2 Invoices are due monthly in advance unless otherwise agreed.
6.3 Non-payment may result in suspension or termination of service.
6.4 H Connect reserves the right to charge reconnection fees where applicable.
7. Cancellation and Refunds
7.1 Customers may cancel a service by providing 30 days’ written notice to info@hconnect.co.za.
7.2 Refunds for prepaid services will be processed subject to the Refund & Cancellation Policy and the terms of Paystack.
7.3 H Connect may terminate a service immediately for non-compliance with these Terms or for non-payment.
8. Data Privacy
8.1 H Connect adheres to the Protection of Personal Information Act (POPIA) and other applicable privacy laws.
8.2 Customer information is processed in accordance with our Privacy Policy.
8.3 Payment data processed via Paystack is encrypted and not stored by H Connect.
9. Service Quality and Fair Usage
9.1 Broadband speeds and uptime are subject to Openserve’s network performance and fair usage policies.
9.2 Excessive usage that affects other users may result in speed management or service suspension.
10. Limitation of Liability
10.1 H Connect is not liable for any direct, indirect, or consequential damages arising from service interruptions, data loss, or unauthorised access.
10.2 Our total liability shall not exceed the total amount paid by the customer for the affected service during the month of the incident.
11. Changes to Terms
H Connect reserves the right to update these Terms from time to time. Updated versions will be published on our website at https://www.hconnect.co.za. Continued use of the Services constitutes acceptance of the updated Terms.
